Securing Debt
Grant credit responsibly.
Credit risk is best managed before funds, goods or facilities are advanced. Security should be selected for the transaction, correctly documented and capable of enforcement when it is needed most.
Security that fits the risk
A valuable asset, a book debt, movable equipment and a shareholder undertaking do not call for the same form of security. The debtor, asset, existing encumbrances and likely enforcement route must be considered before documents are signed.
Documentation and registration
We advise on the structure and arrange the preparation or registration of mortgage bonds, notarial bonds, cessions, pledges, suretyships and related instruments through the appropriate professional network.
Before and after default
Security is most effective when planned at the start, but existing facilities can also be reviewed, strengthened or enforced. Early advice helps preserve options and avoids steps that may weaken a creditor’s position.
